Aurex Developments building works

Terms & Conditions

Last updated: 29 September 2026

These terms explain how we quote for and carry out building work (Part A) and the rules for using our website (Part B). Please read them carefully before you accept a quote. If your written quote or contract says something more specific than these terms, what it says applies.

1. About us

Aurex Developments is a building and construction business based at 23 Hinton Road, Bournemouth, BH1 2EF. You can contact us by email at info@aurexdevelopments.co.uk, by phone on 01202 145995, or by post at the address above.

In these terms, "we", "us" and "our" means Aurex Developments, and "you" means the person using our website or asking us to carry out work. If you are an individual having work done on your own home, for purposes that are wholly or mainly outside any trade or business, you are a "consumer" and you have legal rights that these terms do not take away. If you are having work done for a business (for example on a property you let out as a landlord or investor), you are a "business customer".

Part A: Our building services

2. Quotes and when our contract starts

  • We normally visit your property before we quote. Your written quote describes the work, the price and how it is to be paid, including any deposit and stage payments.
  • Unless the quote says otherwise, it is valid for 30 days from the date it is issued.
  • Our contract with you starts when you accept our written quote in writing, for example by signing it or confirming by email. Verbal instructions alone are not an acceptance. We may withdraw a quote at any time before you accept it.
  • The contract is made up of your written quote (and any drawings or specifications it refers to), these terms, and any changes we agree in writing.

3. The price

Our quotes are a fixed price for the work described in them. We will only ask you to pay more if:

  • you ask us to change or add to the work (see section 5); or
  • once work has started, we discover something that we could not reasonably have seen or expected when we quoted, such as hidden structural defects, rot or unexpected ground conditions.

If either happens, we will explain what we have found, the options and the cost, and we will get your agreement in writing before we carry out any extra work. If something has to be done straight away to make the site safe, we will only do what is needed and tell you as soon as possible.

If you are a consumer, the price in your quote will include VAT where VAT is payable. If you are a business customer, prices may be quoted excluding VAT, which will be added at the current rate.

4. Deposits and payment

  • We may ask for a deposit before work starts. Any deposit, and what it covers, will be set out in your quote. A deposit is a part payment of the price. If the contract is cancelled, we will refund the deposit less any costs we have actually and reasonably incurred, such as materials ordered specifically for your job that cannot be returned or used elsewhere, and any work already carried out.
  • For larger projects, we will invoice stage payments at the points set out in your quote. The balance is due when the work is complete.
  • Unless your quote says otherwise, invoices are payable within 7 days of the invoice date.
  • If an invoice is not paid on time, we will remind you. If it remains unpaid, we may pause the work after giving you written notice. If you are a business customer, we may also claim interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.

5. Changes to the work

If you would like to change or add to the work after accepting our quote, please tell us. We will confirm in writing (email is fine) what the change involves, any change to the price and any effect on the timetable, and we will only go ahead once you have agreed.

Sometimes we may need to change the work because the law or Building Control requires it, or because the materials specified are no longer available. If so, we will tell you, explain the options and agree any change in price with you first. We will not substitute a product or brand you have specified without your agreement.

6. Start dates and timescales

We will give you an expected start date and an estimate of how long the work will take, and we will do our best to keep to them. Building work can be delayed by things outside our control, such as bad weather, delays in the supply of materials, unexpected site conditions, changes you ask for, or waiting for inspections or other people (for example Building Control or structural engineers). If there is a delay, we will tell you as soon as we can, explain why and agree a revised timetable with you. If a delay is our fault and is very long, you may be entitled to end the contract and get back any money you have paid for work we have not done.

7. Your responsibilities

To help us carry out the work safely and on time, please:

  • give us safe access to the property and the working areas on the agreed working days, and somewhere to park or unload where possible
  • make water and electricity (and gas, where needed) available for the work, unless we agree otherwise
  • move or protect furniture, belongings and valuables in and around the working areas
  • tell us before we start about anything you know of that could affect the work or safety, such as asbestos, structural problems, the position of pipes and cables, or boundary issues
  • make decisions and choose finishes in good time, so the work is not held up
  • unless your quote says we will deal with it, obtain any permissions needed before work starts, such as planning permission, listed building consent, landlord or freeholder consent, and party wall agreements with your neighbours
  • tell your home insurer that building work is taking place
  • keep children, pets and visitors away from the working areas

If we cannot carry out the work as planned because one of these things has not happened, we will talk to you about it. We may charge for reasonable extra costs this causes, but we will tell you before we do.

8. Planning, Building Regulations and safety

We will carry out the work in line with the Building Regulations and other relevant laws. Where Building Control approval is needed and your quote says we will manage it, we will make the application and arrange the inspections, and give you the completion paperwork at the end. Planning and Building Control decisions are made by the local authority or approved inspector, not by us, so we cannot guarantee the outcome of an application.

Any notifiable electrical work will be carried out in line with Part P of the Building Regulations, and any gas work will be carried out by a Gas Safe registered engineer, as the law requires.

We will run the site safely under the Health and Safety at Work etc. Act 1974. For work on your home, we take on the client duties under the Construction (Design and Management) Regulations 2015, as those regulations require.

9. Materials and subcontractors

  • Unless your quote says otherwise, we supply the materials for the work.
  • Materials we deliver to your property but have not yet fitted remain ours until they have been paid for. Once they are built into your property, they belong to you.
  • If you supply any materials yourself, you are responsible for them being suitable and arriving on time, unless we have inspected and approved them.
  • Manufacturers' guarantees on products we fit (for example the manufacturer-backed guarantees of up to 25 years on some flat roofing systems) are passed on to you. They are separate from our own guarantee.
  • We may use trusted subcontractors for specialist parts of the work. We remain responsible to you for all of the work, including theirs.

10. Our standard of work and your legal rights

We will carry out the work with reasonable care and skill, and any materials we supply will be of satisfactory quality, fit for purpose and as described. If you are a consumer, the Consumer Rights Act 2015 gives you these rights. If something is not right, you can ask us to put it right at no extra cost to you. If we cannot do that within a reasonable time and without significant inconvenience to you, you may be entitled to a price reduction. For goods we supply, you may have other remedies too. For free, independent advice about your rights, contact Citizens Advice (see section 16).

11. Our workmanship guarantee

In addition to your legal rights, we give:

  • a 12-month workmanship guarantee on completed work, starting from the date the work is finished; and
  • a 10-year workmanship guarantee on roofing installations.

If a defect caused by our workmanship appears during the guarantee period, tell us in writing as soon as you can and we will come back and put it right free of charge. The guarantee does not cover normal wear and tear, damage caused by misuse, neglect, accidents or work by other people, problems caused by materials you supplied, or damage from events outside our control, such as flooding or subsidence. We will confirm the guarantee that applies to your job when we hand the work over. Our guarantee does not affect your legal rights.

12. Your right to cancel (consumers)

If you are a consumer and our contract was made away from our business premises (for example at your home, after we visited to quote) or at a distance (for example by phone or email), you have the right to cancel it within 14 days without giving any reason. This right comes from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

  • The cancellation period ends 14 days after the day the contract is made.
  • How to cancel: tell us clearly that you have decided to cancel, before the cancellation period ends. You can email us at info@aurexdevelopments.co.uk, write to us at 23 Hinton Road, Bournemouth, BH1 2EF, or phone us on 01202 145995. You can use the model cancellation form below, but you do not have to. It is enough to send your message before the 14 days are up.
  • Refunds: if you cancel, we will refund all payments you have made to us, including any deposit, within 14 days of the day you tell us, less any amount you owe for work already carried out (see the next point). We will use the same payment method you used, unless you agree otherwise, and you will not be charged any fee for the refund.
  • If you want work to start within the 14 days: we will only start work during the cancellation period if you expressly ask us to in writing. If you then cancel, you will need to pay a proportionate amount for the work we have carried out up to the time you tell us you are cancelling, based on the contract price.
  • If the work is completed within the 14 days: if you asked us to start work during the cancellation period and confirmed that you understood you would lose your right to cancel once the work was complete, you cannot cancel once we have fully completed the work.
  • Made-to-measure items: the right to cancel does not apply to goods made to your specifications or clearly personalised, such as made-to-measure windows, doors or joinery ordered for your job.
  • Urgent repairs: if you specifically asked us to visit to carry out urgent repairs or maintenance (for example an emergency roof repair), you cannot cancel that urgent work. If, on that visit, we also agree to carry out other work or supply other goods that go beyond the urgent repair, you can cancel that additional work or those goods in the way described above.

13. Ending the contract after the cancellation period

After the cancellation period has ended (or if you do not have a right to cancel), you can still end the contract by telling us in writing. If you do, you will need to pay for the work carried out up to that point, for materials ordered for your job that cannot be returned or used elsewhere (or the cost of returning them), and for any other reasonable costs we have incurred as a direct result, less anything you have already paid.

14. If we need to rearrange or end the contract

We may occasionally need to rearrange work because of bad weather, illness or other things outside our control. If so, we will tell you as soon as possible and agree a new date with you. If we cannot agree a new date, either of us may end the contract, and we will refund any money you have paid for work we have not carried out.

We may end the contract by giving you written notice if you do not pay an invoice after we have reminded you, if you repeatedly prevent us from getting access to the property, or if conduct on site stops us from carrying out the work safely and reasonably. If we do, you will need to pay for the work carried out and for materials ordered for your job up to that point, less anything you have already paid.

15. Our responsibility for loss or damage

If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of us breaking this contract or failing to use reasonable care and skill, including damage we cause to your property. Loss or damage is foreseeable if it is obvious that it would happen, or if we both knew it might happen when the contract was made. We are not responsible for business losses, such as loss of profit, loss of business or business interruption.

If you are a business customer: we are not responsible for any indirect or consequential loss, or for any loss of profit, rent, revenue, business or goodwill, and our total liability to you under or in connection with the contract is limited to the contract price.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Nothing in these terms affects your legal rights as a consumer.

16. Complaints

If you are unhappy with our work or our service, please tell us as soon as possible by email, phone or post using the details in section 1. We will acknowledge your complaint within 5 working days and aim to resolve it within 14 working days. If we cannot resolve it, we will tell you in writing whether we are willing to use an independent mediator or alternative dispute resolution scheme.

If you are a consumer, you can get free, impartial advice from Citizens Advice on 0808 223 1133 or at citizensadvice.org.uk.

Part B: Using our website

17. Using this website

By using this website, you agree to this Part B. You may use the website to find out about our services and to contact us. You must not misuse it. For example, you must not try to gain unauthorised access to it, interfere with how it works, introduce viruses or other harmful material, or use our quote form to send spam or unlawful content.

18. Information and prices on the website

The information on this website is general information about our services. It is not advice about your particular property and it is not an offer to carry out work at a particular price. Our guidance on planning permission and Building Regulations is a general guide only; what applies to your project depends on your property and on the decisions of the relevant authority. Your written quote sets out exactly what we will do and what it will cost, and it takes priority over anything on this website.

19. Our content

The content of this website, including its text, logos, photos and design, belongs to us or is used by us under licence. You may view it, and print or save pages for your own personal use, but you must not copy it or use it for any commercial purpose without our permission. Other names and logos shown on this website belong to their owners.

20. Links to other websites

Links to other websites, such as WhatsApp or Aurex Plan, are provided for your convenience. We do not control those websites and we are not responsible for their content.

21. Availability, viruses and our responsibility for the website

We try to keep the website available and accurate, but we cannot promise that it will always be available, error-free or up to date. We take reasonable steps to keep it free from viruses, but you should use your own virus protection. The website is provided free of charge. We are not responsible for any loss caused by relying on general information on the website instead of your written quote. Our responsibility for our building services is set out in section 15.

General

22. Your personal information

We use your personal information as explained in our Privacy Policy.

23. Changes to these terms

We may update these terms from time to time. The latest version will always be on this page. The version that applies to your building work is the one in force when you accepted your quote, unless we both agree otherwise in writing.

24. Other important terms

  • If a court decides that any part of these terms is invalid, the rest of the terms will still apply.
  • Nobody other than you and us has any right to enforce this contract.
  • If we delay in enforcing any of these terms, we can still enforce it later.

25. Which laws apply and where you can bring proceedings

These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in the courts where you live.
